State court rules on oil pipeline insurance

With two liberal justices abstaining, the Wisconsin Supreme Court issued a 4–1 decision that Dane County cannot require Enbridge to carry more insurance despite tripling the amount of crude oil moving through its pipeline. The vote reverses an earlier appellate court decision.

Enbridge’s pipeline cuts through Wisconsin from Superior to the Illinois border, including a 12-mile stretch through the northeast corner of Dane County.

In 2017, according to a Wisconsin State Journal report, Dane County agreed to allow Enbridge a conditional use permit to build a pumping station, as long as Enbridge carry extra spill insurance. Other permitting delays along the line are also slowing the oil flow.
