Funeral home case could be headed to state Supreme Court

A ban on joint ownership of funeral homes and cemeteries was upheld by Wisconsin’s 2nd District Court of Appeals, which found such a ban to be constitutional.

New Berlin-based Highland Memorial Park filed suit in 2016 arguing that a state law banning the co-ownership of funeral homes and cemeteries was unconstitutional. The park’s owner reportedly wanted to begin offering funeral services as well as burial/interment services.

A Waukesha County Circuit Court rejected the lawsuit in 2016, and now Highland Memorial Park has lost on appeal.

The matter may be heading to the Wisconsin Supreme Court, according to the Wisconsin State Journal.
