Dane County judge sides with public health department on setting COVID-19 restrictions

Circuit Judge Jacob Frost sided with Public Health Madison and Dane County in a decision on a suit brought by Wisconsin Institute for Law and Liberty, according to a Wisconsin State Journal report. Frost noted the plaintiff’s “political goal” and refused to issue a temporary injunction blocking health officials from issuing orders aimed at preventing the spread of COVID-19. The decision found that the state gave the director of Public Health Madison and Dane County the authority to issue an order in January setting outdoor gathering limits at 50 people and limiting businesses to 50% capacity.
