Condo association files suit to block Pacific Cycle expansion
The Whitcomb Village (Condo) Association has filed suit to block Pacific Cycle’s expansion, alleging the expansion to an adjacent property would violate an easement the association was granted in 1972. The condo association maintains Midwest Equity Properties cannot change or end the easement without the condo association’s consent, and seeks a judgment barring such an action.
Pacific Cycle is located at 4902 Hammersley Road in Madison. In February, the Madison City Council unanimously approved rezoning for its expansion to 4908 Hammersley Road, which would require the demolition of an existing home.
The lawsuit claims the easement provides sanitary sewer and pedestrian access to Hammersley Road from the condominiums.
