Chocolate Shoppe to leave Atwood location

Under the terms of a legal settlement, Chocolate Shoppe Ice Cream will leave its Atwood Avenue store by Oct. 31, according to an article in the Wisconsin State Journal.

The settlement, filed jointly last week by Chocolate Shoppe and landlord D-Port Properties, essentially dismisses a lawsuit filed by Chocolate Shoppe CEO David Deadman after he was locked out of his place of business in early October. D-Port Properties is the new owner of the building, which is located at 2302 Atwood Ave.

Chocolate Shoppe, which for the past six years has sold ice cream out of the 354-square-foot building on a seasonal basis, still has six other retail locations in Madison, Fitchburg, and Middleton.

Attorneys representing D-Port Properties said that when the building was up for sale, Deadman had the right of first refusal and declined to buy it.
